We are offering a trademark application flat fee package for $2202.14 on Valentine’s Day (2022-02-14). There is a financial barrier to accessing your legal rights and powers, as well as protecting your assets. We are working to balance the scales by offering a flat fee package that reduces the cost by at least $1,400.00.
We are offering a limited number of these packages to help small businesses protect their brand. Not having a registration for your trademark is like building a house on land you do not own. Someone can take it away from you. Let’s make sure you own your land. The package includes:
-Knock out search using artificial intelligence (no sense in spending money to protect a mark you will never get or that will cause another company to file suit against you)
-USPTO Fee for one class of goods/services (you can add classes for $400 each if more classes are needed to protect your brand)
-Response to one administrative office action (minor issue such as amending identification of goods/services, disclaiming a word, submitting a new specimen, or other response that does not require legal arguments-please note there will be an extra charge for responding to a substantive rejection, such as likelihood of confusion or merely descriptive rejection)
-Reminding of foreign filing deadline and providing guidance about protecting your brand in foreign countries (please note there will be an extra charge for sending your application to be filed in foreign countries)
-Reporting Notice of Publication to you
-Reporting status of oppositions filed against you (fingers crossed there will be none-please note there will be an extra charge for handling an opposition if the unlikely event occurs and one is filed against you)
-Sending you the Certificate of Registraation (if granted) and reporting renewal deadlines to you
-Up to 1.5 hours of attorney consultation time phone time
TERMS AND CONDITIONS
No guarantee is made for being able to register your mark. Trademark law is nuanced and even if your search comes back clear and everything looks good, there is a small risk the USPTO will decide not to register your mark.
Payment must be made through the button in green below to secure package while supplies last. Once payment is made, we will conduct a conflict check. If a conflict for representing you is found, we will refund all of your payment. Once the conflict check is cleared, we will send you a General Intake Form and a Trademark Intake Form.
Both forms need to be completed within 24 hours of us sending the forms. If the forms are not completed in that time frame, we reserve the right to cancel your purchase. Once the forms are submitted, we will send you our Letter of Engagement. If you do not sign the Letter of Engagement within 48 hours of it being sent, we reserve the right to cancel your purchase. You have the right to have an attorney review our Letter of Engagement. If you need more time, please send us an email letting us know and we will be happy to give you the time.
Once the Letter of Engagement is signed by you and firm, the firm represents you. No representation will commence unless the Letter of Engagement is signed by both you and the firm. Once the Letter of Engagement is signed, we will review your Trademark Intake Form and reach out if we need anything more to have the search completed. Once the search results are received, we will review them and provide you with an analysis of the results along with suggestions on how best to proceed.
If the search results show you have a low likelihood of success with registering your mark, we will either perform one more for you (included in the package) or provide a partial refund of $1,650.00. The Firm will keep $554.14 for performing the search and providing our analysis of the results.
If we find you are not using your mark as required by the law to register it, we will file an intend-to-use application for you. When it comes time to prove use and respond to the Notice of Allowance (if the USPTO decides to register your mark), you will have to pay the USPTO fee for filing the Statement of Use (current fee is $100). Our time for filing the response to the Notice of Allowance will be included in the package.
